FOR VALUABLE CONSIDERATION, each party acknowledges the receipt and sufficiency of which, this agreement is made this ___ day of _____________, 20___.

BOARD and MONTHLY PAYMENT:

Lessors shall provide barns and pasture.
Lessees shall provide their animal(s) with water and feed as necessary.
Lesses shall board only animals which they own at farm.

In consideration, Lessee shall pay to Lessors, commencing on ____ day of __________, 20___, the sum of $______ per month, payable on the fifteenth (15th) of each month preceding all months in which payment is due (ea. February's board due by January 15, etc.). In no circumstances shall Lessors make refunds of any kind or type in any amount. Lessors shall have the right to increase the cost of the aforesaid board and monthly payment fee upon thirty (30) days' prior notice to Lessee.

TERMINATION:

Failure of Lessee to make a timely payment of any installment due hereunder shall give Lessors the right, in their sole discretion, to immediately terminate the board agreement. Irrespective of such termination, Lessors shall still have the right to collect from Lessee any sums due hereunder, and to enforce against Lessee any other rights accorded Lessors hereunder.

FARM RULES:

Lessee agrees to abide by all rules established by Lessors, whether orally or in writing.

LIEN:

Lessors shall be entitled to a lien against the boarded animal(s) for the value of any and all services and materials provided or rendered and unpaid by virtue of this agreement and pursuant to North Carolina law. Until all such charges are paid by Lessee, Lessors shall keep possession of the animal(s), and boarding charges shall continue to accrue.

FARRIER and VACCINATIONS:

Lessors shall have no obligation to provide vaccinations or farrier services. Lessee shall pay for services, as shall be desired by Lessee.

No rear shoes shall be allowed on any horse(s) ... for safety reasons.

VETERINARIAN:

Lessors assume no responsibility to ascertain the necessity of, or obtain, farrier or veterinary care for the animal(s). However, should Lessors reasonably believe that such care is necessary or desirable, lessors are authorized to call any licensed veterinarian of their choice.

All fees charged by the above veterinarian shall be the sole and exclusive responsibility of lessee, who shall pay the fees when due. Lessee agrees to indemnify and hold Lessors harmless from any and all such costs, including the reasonable costs and fees of enforcing said indemnification. Lessee releases Lessors from all claims and liability associated with the treatment of the horse by the veterinarian, and further releases Lessors from all claims and Liability for injury or damage or death of the animal(s) if not treated by a veterinarian.

RELEASE:

Lessee hereby releases Lessors from any and all claims associated with the boarding of Lessee's animal(s), except as to the obligations specifically set forth herein above.

ASSIGNMENT:

Lessee shall not assign their rights hereunder.

This Boarding Agreement, together with the Liability Agreement constitutes the entire agreement between Lessee and Lessors. The Liability Agreement is attached hereto as page 3, and by this reference is made a part hereof.

LIABILITY AGREEMENT

The undersigned agrees for valuable consideration, the receipt and sufficiency of which is acknowledged, that (s)he, and any relative(s), friend(s), and associate(s) of the undersigned, who enters the farm do so at their own risk and that Randy and/or Judy Lucas shall not be liable under any circumstances (whether due to the negligence of proprietor, its employees, or otherwise) for any injury to person(s) or property including death, consequential damages, economic loss, or other consequences or results of such injuries or any loss or damage suffered while on premises of the property.

The undersigned agrees to indemnify, hold harmless, and save Randy and/or Judy Lucas of and from all such liabilities and all claims and attorney's fees for any such injuries, loss, or damage, whether sustained by undersigned or any relative(s), friend(s), or associate(s) brought upon the property and/or Randy and/or Judy Lucas by the undersigned.

WARNING Under the Equine Activity Liability Act, each participant who engages 2/25/2001 in an equine activity expressly assumes the risks of engaging in and legal responsibility for injury, loss, or damage to person or property resulting from the risk of equine activities.

The terms of this Liability Agreement apply to all animals boarded at , whether on or off property, and any other activities performed on the property.

This Agreement shall be attached to and by this reference is made a part of any and all Lease and/or Boarding Agreements between the parties hereto.

GENERAL:

  1. Golden Rule; Treat this place like your own! If you open a door, close it ... Open gates ... close them, turn on a light ... shut it off before you leave.

GRAIN:

  1. Sweep up the grain your animals do not eat. Throw it outside in the pasture for the birds to eat. This will keep the mice & rats from coming!
  2. If you must keep grain at the barn, it must be in a locked, steel container.

LAWNS & PASTURES:

  1. Only ride in the fenced pasture on farm or the access road.
  2. Keep off the lawn and grass areas outside the fenced pasture!
  3. Keep off the neighbors grass.

FEEDING:

  1. Lesee is responsible for feeding and watering animals.
  2. You may feed grain, but heed the GRAIN rules.

GARBAGE:

  1. Take it home with you ... where it came from, or don�t bring it!

LOITERING:

  1. This is a farm for your animals. It is not a park or picnic area.

HOURS:

  1. Open 7 days ... 365 days a year. Go home around 9 PM daily.

CHILDREN under 16 yrs:

  1. Must be fully attended to ... AT ALL TIMES, AND ARE NOT ALLOWED IN THE PASTURE or the CORAL, at any time!

RIDING:

  1. All riders must sign a LIABILITY AGREEMENT, before they ride (they sign it once only).
  2. No subleasing of your animal(s) to another individual.
